Property belongs

If your father had not left any WILL, then the property left behind by him will be EUQALLY shared between his legal heirs.

Your father's legal heirs are:

1. His mother (if alive)

2. His wife (your mother, if alive)

3. All his sons and daughters

4. The pre-deceased son's son(s) and daughter(s).  

5. Widow of a pre-deceased son. (i.e. deceased Elder son's wife/widow)

In your case property will be divided in deceased son's legal heir one share and other 2 share in other son and daughter.
