Property claim

My father invested in a property in coimbatore and it was registered in my grandmothers name. After my father passed away that house was occupied by my fathers elder brother. He was staying there for past 15 years and without our notice he has sold that house and taken full share. We are left with no documents on the house as it was with my father's brother on bank loan. Please suggest how we could claim our share on the house.they have removed my fathers name in the legal certificate and claimed that he is the only son to my grandmother.

Apparently it is case of  fraud.

Legal hier certificate is not given just like that.

Probably the person has signed an affidavit before tehsildar/Ex. Magistrate that legal heirs are..................and as per you it is false. This is evidently doen to defraud the other legal heirs.

 

You have not posted which personal law applies e.g. Hindu Succession Laws?

If the deceased owner was a Hindu female; then her property shall devolve upon her husband and children, if the property was self acquired/absoloute or acquired from husband.

The money disappears very fast. 

Approach a very able counsel ASAP.
