Property dispute

My grand father has gift settled his self aquired property on my father's name , all other properties were distributed to other two uncles , now my uncle trespassed into our property and claiming that he sent some amount for construction, thought he sent some amount it was given for her family's maintenance, will his partition suit work? We have filed for eviction.how strong are we in winning? PS:my grand father is still alive

your uncle cannot succeed in this case. He can claim money which he had sent for construction but he cannot claim right in the property. You have right to evict your uncle as he dont have right in the property, even if he is able to prove that he had sent money for construction, he can file suit for recovery of money but he cannot claim title in the property. If you want I wil provide judgments on this type of issue.
