We got my father Own earned property (House) and Some cash. We are 5 Children (4 Sisters + 1 Son (me). My father has left one house and around 20 lacs cash with out writing a will. He left cash for my mother which is deposited in the bank on her name. Now i got married last year and have a male child.
Family Members of My father:
4 Daughters
1 Son
1 Widow (my mother)
1 Grand son (Born after his death)
I just want to know following points:
1. Whether the property needs to be divided into 7 partitions or 6 partitions.
2. Do we need to divide the cash also.
3. Do my Son gets separate Share out of his grand father property.
Actually, my 3 sister, me and mother want to register the property on my son's name. But one sister is not signing it. I think all the 6 members needs to sign in front of register for registration.
I think as per act, if we divide the partition only we need to give share to the daughters, if we are not dividing the property, daughter do not have right to ask for partition.
Please clarify ASAP.
