Check if she has made any Will...

1. The property will be shared in equal parts by children of the deceased Hindu female (assuming she to be Hindu female) and with Widow Husband in case when no will she left behind in favor of her then husband. S. 15 and S. 16 HAS, 1956 and Amended 2005 referred to.
2. He is still treated as her legal husband as no clear Decree in a divorce proceedings they managed before the other spouse died in an accident.
3. In case she has Will then the matter would be already detailed in her Will.  

He should search and hire via reference an Advocate to lay such claims if any accordingly.

Yes he is entitled along with kids. If no kids, he does not get property. All this applies, if she has left no will.
