You said you have filed the cases against your uncle, but where is the question of stamp duty, what is the exact problem, without letting know the problem you will not be able to get proper answer.  What is your lawyer telling, did he ask  for extra money for stamp duty etc., if so how much?, what is the value of the property ?, please come out with actual problem, so that you can get proper opinion.

thank u for ur kind reply sir they say that we have to pay some court duty of about 2 lacs cause the property os the value in chennai is more than 2 to 5 crores. hence we are in just earn our income in salary basis we are unable to pay the court fees and as well as this advocate fees so we requested them to get their amount once we get settled our property they may get their fees and duties whatever under court rule.

@Kanchana Surendranath:  You have been thoroughly misguided by somebody that you have to pay the court fees to that extent.  The court fee is very less but the advocate fee may depend on the advocate you intend to engage with regard to his standing and other professional demands, also you cannot bargain with an advocate that you will pay him once he wins your case by selling the property etc., this is  unethical and unacceptable to anyone including me if I am to be engaged.  I or any advocate would like to be paid with the fees for the services rendered and not for  the results.  So clarify the fee and other details properly from the advocate you consult for the purpose, if it is okay for you, proceed, or else look for some one suiting to your taste.
