Hello Law Experts,
My Father owns property and wants to make partition among my brothers and sisters. Some property he got it from my grand father as gift and he is enjoying the gifted property for the last 4 decades(40 years). In between he also brought some piece of land from his own earnings. My father has total 4 sons and 2 daughters. Due to some misunderstanding between my father & my third brother, MY FATHER DOES NOT WANT TO GIVE ANY SHARE FROM THE PROPERTY(INCLUDING MY GRANT FATHER GIFTED PROPERTY) TO MY THIRD BROTHER AND MADE THE PARTITION AMONG MY OTHER BROTHERS AND SISTERS(INCLUDING ME).
Now, My third brother is planning to take legal action against my father and sue him as per SHARIAT LAW.
Is there any provision in Shariat law or Indian Property law that he can get his share of property from Law of Court?
