Property partition dispute - Urgent Help needed

My father bought 32 cents land out of total 35 cents in three documents (17+6+6+3) from a private party and my uncle bought remaining 3 cents. In both party sale deeds, the four side boundaries is given for the total 34 cents without partition. When we tried to do partition, we came to know that only 17 cents are available in the land and the remaining 18 cents were encroached by a third party for more than 50 years. Even though they don't have patta or any proving document, we came to know that it is legally difficult to move them out. On knowing this, my uncle is trying to sell his 3 cents stating that his portion of land is inside the available 17 cents. I would like to know

1) How to stop his sale procedure

2) Who owns the right to decide which portion is for whom?. FYI, my father registered the land first and we own majority of portion (32/35).

Requesting your help at the earliest as my uncle is moving very fast to sell his portion of land. Thanks in advance.
