Property registration

Dear All,

I need some assistance in case where the property has been inherited and whether it is to be registered by the owners who has the proeperty owned by inheritance. Following is the case.

The porperty is one of the property of co-operative society and it was in the name of a Person. The Person nominated his two sons for the property. The person died and now as per nomination the two sons are the first to have the right to the ownership of the property.

I have following questions:-

1) Whether the two sons have to pay stamp duty and register their name with the government?

Or, whether the procedure done by the co-operative society is enough?

Or, the two sons have to only intimate the relevant government departments? If so, then which departments are to be infromed.

2) Whether any other relative of the Person can claim their right?

your question is a bit confusing ealborate with more details. once you are telling co oip society then you are telling in personal name the property is registered. what does this mean.

Hi

My mother had purchased a flat for Rs 7.50 lakhs in 1991. She paid the stamp duty but did not register the flat. After she expired and now since I inherited the flat I want to sell the flat do I have to register the purchase agreement that she had made and if so will I have to pay a penalty. Can anyone from Mumbai please tell me what would be the registration fees that I would have to pay in this case if applicable.

Thanks for the reply.

First the co-operative society is registered and then the plotting is done of the land and then the plots are sold to the buyers. There are some rules and procedures set by the co-operative society under co-operative societies act, for purchase,sale,construction of houses, etc. of these properties. The property has been purchased and is in the owner's name and the owner nominated his two sons for the property. Now after the owner is deceased the sons as per nominations become the owners, do they have to register their names with the registration office? If yes then do they have to pay the stamp duty for registration?

Secondly I donot have the agreement between the builder and the original buyer of this flat in this case what should I do.
