Property transfer from mother

hai,

my grand father has 3 sons ( including my father), we had some agricultural lands. my father and his brothers wrote a partiton deed ,dividing the properties equally and fairly.

my father expired in 1990 when i was 10 years old and my sister 8 years old. after my father's expiry the legal hiers are me , my sister and my mother. the properties are transfered to my mothers name ( may be becos we both are minors).my sister got married in 2000 , we bought her some agricultural land and gave it as dowry. and she is done . now i am married and my mother want to transfer all  the agricultural lands( gift registration) we inherited to me. so how should i register the property, is it ok if my mother alone transfers to me or should my sister also be included in the registration process. if so how ???????????

Dear Anand,

Yours is a ancestral property, and after your father's death, the property devolve to you, your sister and mother respectively.  Their rights are still involved, even though , your sister is married and you have bought some land and gave it her as a dowery, if she is satisfied, and your mother want to gift you the said inherited property in your name, first , get the relinquish deed executed by your sister, that , as she has gave up all rights in your favour and mother's favour, after that, your mother can easily signed the gift deed.

This is ancestral property so all legal heirs right in this property.
