I ,XYZ , JOINED IN A PSU AS SENIOR ASSISTANT IN YEAR 2003 . THE QUALIFICATION FOR THE RECRUITMENT WAS BSC/DIPLOMA/BTECH . THERE WERE TWO CHANNELS OF RECRUITMENT . ONE WAS THROUGH NON EXECUTIVE AS WAS WITH ME. SECOND WAS THROUGH EXECUTIVE LEVEL WITH QUALIFICATION AS BTECH/MSC. SOME PEOPLE IN OUR RECRUITMENT JOINED WITH MSC/BTECH QUALIFICATION. IN YEAR 2005 A DEPARTMENTAL EXAM WAS CONDUCTED AND THE PERSONS WHO WERE HOLDING MSC/BTECH QUALIFICATION WERE GIVEN THE CHANCE TO SIT THE EXAM. OTHER BATCH MATES WERE NOT CALLED FOR THE EXAM WITH THEIR FELLOW RECRUITS. 1. whether this was legal or illegal. again in 2012 i was called for training , but due to some unavoidable conditions i was not able to join air traffic control training. unfortunately i was never again called for training and never given promotion. recruitment is discontinued on my post, and lost my seniority. air traffic control training is specialized one . what relief i can get. going back to year 2005 the then sr supdt were given promotion without training with clause that they will complete their training within two years . what relief i can get on this entire matter , plz do needful

File a writ petition on the basis of natural justice and challenge it before Hon'ble High Court better if you contact us then I will elaborate properly about your case.

First of all, for the events that had taken place way back in 2003, 2005 and 2012 you are asking advise now. Its difficult to convince the Court to accept your case due to efflux of time. We sleep over our rights, we do not get them. It does not mean that you have right then also but I wish to highlight the need for active and prompt action if aggreived.

 

Further, nobody can give you any advise without going through your service conditions, promotion policies etc. of the organisation where you are working. 

 

Therefore, I sincerely advise you to approach a capable Lawyer, who is specialising in matters relating to Employees and their promotion etc. with full details first to find out whether you have a case or not. If there is a possibility of a case, better take second and third opinion and then only commit yourself to file a suit againtst your employer. Hasty action is not advisable.
