Public nuisance with shop setup in neighbouring plot

A new shop has come up in my adjacent house which sells Kirana items including cigarattes in a residential area.

The shop is kept open until 10:30 causing inconvenience to our family (both senior citizens - father heart patient), due to continuous smoking by Customers.

Secondly shop setup in residential plot and no objection certificate not taken from me (immediate neighbour).

Please advise as to what is to be done to close this shop or atleast stop them from selling cigarattes which is causing Passive smoke and health problems to my Family.

Thanks Sheikh Mohammed Ali,  please let me know if an No Objection certificate is needed from immediate neighbour for setting up shop.

2. Can a shop be setup in a residential area, and operate beyond 9 pm
