Quantum of reserve posts in a rank

Assistant Commandant rank is Group A promotional post in ministerial cadre of CRPF(MHA). Inspector ranked personnel are promoted to this rank on basis of vacancies. As on date out of about 173 posts of Asstt Commandants approximately 90 % of the posts are filled of SC & ST candidates. These SC/ST candidates get promotions faster than their General category counterparts in the rank of Inspector, sub-Inspectors and Asstt Sub-Inspectors. And by virtue of reservations in all these promotional posts, all SC / ST category candidates are in the rank of Asstt Commandant.

We the General Category personnel although were senior to many of them in respective gradation lists but by virtue of reservations only SC/ST personnel have been considered for promotion. I desire to ask whether filling of 90% posts only from reserved candidates is justified and whether there is any scope for General category personnel to restrict the SC/ST personnel to any rank/ post so that they cannot  cross 50% of the total posts.

1) There is no question of 90% Rule of Reservation (RoR) for SC/ ST as understood by you which otherwise becomes unconstitutional.

 

2) The 100 point roster on RoR is followed and the backlog might hv been cleared which may appear to u as beyond total 50%.

 

3) With periodical inspection of Rosters, it will not go beyond the stipulated % in the given year be it recruitment/ promotion.
