Queries on MOU

Me and my wife we are entering into an MOU. I have few queries on the same.

 

1. How to make both the parties binded(bound) in the court of law as we are mentioning that party that violates the MOU clauses will be prosecuted for civil and criminal cases. Should we register it? whats the procedure to make it legal.

 

2. We are also mentioning that whoever violates have to compensate the other party for X amount? is it valid to have such a clause in MOU to bind both of them?

 

3. Parents are also included as Other parties to bind them to not to violate the MOU by wife/husband, so that parents are also covered for prosecution. Is it right to have such a clause. 

 

PS: The MOU is written on a 100Rs stamp paper and this is for a matrimonial dispute. Ultimately we will go for divorce as mentioned in the MOU.

2nd and 3rd clauses sound good. First one doesn't sound legally tenable.

memorandum of understanding (MoU) is a document describing a bilateral or multilateral agreement between two or more parties. It expresses a convergence of will between the parties, indicating an intended common line of action. It is often used in cases where parties either do not imply a legal commitment or in situations where the parties cannot create a legally enforceable agreement. It is a more formal alternative to a gentlemen's agreement.Mutual consent Divorce is good. Instead of simple divorce petition.Decree can get immediately.
