Query on common area in co-operative society shops

Hi,

I have a query on co operative housing sciecty, we have shops in our co-operative housing society and some of them have occupied (put shelter in front of their shops) the area in front of their shops, for which they are not paying any maintenance. Could any one guide whether they are entitled to occupy it? if yes, under which bye law it's allowed please guide

they are illegal occupant, tresspasser but move them carefully, they may file a suit for permanent injunction stating that they are legal occupants and if they were to dispossed from the property means, it should be by ways of Due Process of law... 

such practise is common in all market region.

Complaint to bmc for illegal encroachment. If you have sanctioned plan then bmc also can issue notice under MRTP Act
