Recovery of salary what to do?

 

Hello sir,

Myself Amit Pandey working in a PSU (Bharat Heavy Electricals Limited Noida).

I have a grievance regarding my sixth pay revision. In my pay revision the HR and finance has revised my salary according to their circular. In that revision they have given us (all of my batch mate) a fitment benefit of 30% and the salary is made according to that revision. Now in this year they have found that this benefit is not applicable to us so they have made a new revised salary for us. According to this revision my new salary is less than the drawn salary. Now they are going to recover the amount that is given extra in every month salary for last 38 months.

Is there any possibility so that the recovery for the previously given amount should not be made. The fault of the wrong salary revision is from company end and I am not aware about that. How can I pay that amount collectively which is given to me in 38 months.

The fitment benefit is paid as salary component, or perk, or allowance.

Salary can not be decreased.

You are working with a good company. Proceed accordingly.

Your PSU is a big company having proper HR, personnel, accounts dept.

They might have not erred while circulating decision to deduct.

It shall be better to show all documents, circulars, etc to a competent lawyer.

You have mentioned lots of employees are affected. If the legal advice is company can not, then all of you can proceed jointly.

If company is found to be correct and you need to pay back, all of you can represent to the management to deduct in installments. If you are a member of a recognized union/IC, they can take up the matter.
