I request to all learned persons to kindly help me. I had given an Unsecured Loan to a partnership firm from my HUF in march '13. I had received Interest on this loan in this sept. and will get TDS Certificate soon. My brother is also partner in this firm. His other three partners had started bullying him. Now, kindly advise on these questions:-
1. How can I recover my amount from this firm?
2. If I initiate any legal proceedings, then what will be there effect on my Brother?
3. If there will be any effect, how can I safeguard my brother?
TO make case more clear, let me share some more info with you all.
1. There is no Capital of my brother in the Firm.
2. Partnership is at will.
3. When I gave loan then this was a Proprietor Firm after that it was changed to Partnership Firm.
Please guide me as this amount is very hard earned money.
