Recovery suit

I had a joint account in a bank with my father. Father sold some property and had put some money in that account. Out of that he gave 5 lacs to a relative. He may also have given a letter that it is a gift. But not sure.

Now that relative has started some litigation with us and we want to recover the money.

1. Who should file for recovery? Father, me or both?

2. What is the effect of the gift letter since i had not signed it and it had gone out of a joint account?

if the money is transfered from the joint account then you can also file recovery suit against him and gift can be challenged bu you on certain grounds but before that we need some more details .feel free to contact on advocate_anish@imap.cc and 9459321520
