Redevelopment instead of regularisation?

This is for a CHS members in distress.

In 1990 a rogue builder constructed a 5 storied building in Andheri E without obtaining necessary BMC approvals and vanished after selling all the flats and didn't even conveyed the land in the name of society.

In the said society approval for construction was for ground floor only and remaining 4 floors are illegally built.

Society has in 2022 obtained Deemed Conveyance with intention to redevelop the building.

In this scenario can society go for redevelopment without regularising the old building?

I m posting this query here to get in touch with an advocate for consulting him but he must be knowledgeable & Not just greedy one. TIA

Without regularizing the old building, the society may face challenges in obtaining the necessary approvals for redevelopment. Additionally, redevelopment without regularizing the old building may also be in violation of local laws and regulations, which could lead to legal issues and potential penalties.

It is recommended that the society consults with a legal expert and the local authorities to determine the necessary steps to regularize the old building before proceeding with the redevelopment process.
