Refund of token amount

Respected Sir/Madam,

Around 3 months back we had seen 1 flat and there after we paid the TOKEN amount of Rs.25000 to the Seller via Cheque.
On the reciept for the TOKEN amount Seller had given a letter on a blank paper stating that the deal shall be completed by 31st Dec 2012 and all the required documents from his side shall be prepared by Seller.

Later we found that many of the Utility bills was not on his name(Seller was the 3rd Owner) and he has not even cleared his society maintaince dues for atleast 2 yrs.
Now is has started speaking rudely to us using bad words.

Now we are planning to withdraw the deal and can we claim our Token Back from the seller

Following are the reasons for withdrawal.
1. As per his statement the deal shall be completed by 31st Dec 2012.
2. Paper Utility Bill be transfered to Sellers name, which has not been done.
3. Society maintaince dues not cleared for last 2 yrs...Seller says we do it on the same day of Stamp Duty and Registration.
4. Most Important thing his behaviour has changed.

Pls suggest.

You can send a Legal Notice to tje Vendor to claim your money return,if if would not comply then file case in District Consumer Forum or you can file suit in Civil Court but best option is Consumer Forum.You can also file a criminal case inMagistrate Court.
