Hai Learned Friends i am conducting  an appln to condone the delay in preferring the complaint U/S 138 of N.I Act wehmently, because the petitioner/complainant had alleged that he suffered fracture in his left leg and hence he could not meet his counsel because he was under treatment. But in order to prove his contention he had produced an medical certificate issued by an general practisiner and not by an ortho. As per section 5 of Limitation Act each and every day of delay has to explained satisfactorily. But in the case on hand a general medical practisioner is not competent to treat facture. Is there any citations/judgement in this connected facts in favour of respondent/accused. Please inform me and i will be thankful ever for our community people in this blog.
