Regarding ancestral land sale

Hello greeting, i am from rajasthan. We had our ancestral land in our village around 22 bigah. In 2004 my father was going through some major health problems like high depression, anxiety issue, heavy consumption of alcohol etc etc. doctor prescribed medicine which make them feel unconscious. During this due to some financial issue he sold our ancestral land 18 bigah out of 22 bigah and buyer made registey of 22 bigah and have taken benifit of my father unconscious mind.

Now i want to ask

Wheter i can claim our ancestral property because the buyer has made a fraud i agree that he purchased 18 bigah and rest 4 bigah he has taken inappropriatly.

Note in registery no other sign then my father is there. And i was minor at that time.

Your father signed the document and it is not possible to get the extent. If you have any strong proof that the buyer deceived your father get registration for the full extent of the land instead of 18 bigha then file a case.

Hello thanks for your reply.

i have all the medical documents of that time in which after looking it can be very clear that the mental state of my father was not good to make this contract. Can i use them to proof. I have many prescripttion from 2000 to till date.

SInce the property is sold already and sale deed rergistered by court you can do nothing

If you accept that your father sold 18 bigas of land under full consciousness then it can be construed that he sold the enitre 22 bigas of land in the same state of health.

Hence your case may not be maintainable

You were a minor at that time hence you cannot confirm that your father was mentally stable or not.

Besides you cannot claim him to mentally unstable only for additional 4 bigas of land sold then
