Regarding car selling fraud

I purchased a car a week back.On car advertisement it was written that its driven 36k km.

But after buying when i got service records from the sercving shop it showed that car is driven more then 60k km.

I have the printout of advertisement showing wrong KM posted by seller and service records depicting actual km run.

Seller is not returning back my money as i want to return the car.

he says he does not know anything about it and says how can he trust whether i have not anything wrong wid his car in this one week.

can i go to police for this ?how would police punish the seller ?

The vendor is right that what is the guarantee that you have not done any damage to the vehicle due to an accident or otherwise.  If this difference is going to make difference and you are aggrieved, it should have been checked by you before purchasing it, you cannot claim it due to your fault.
