regarding co.op housing society

can housing society form if there are illegal inhabitants and having legal proceedings in a criminal court ?

Sir, what I mean is the builder had build few illegal flats and sold them, but the purchasers have filed court case in lower court against builder.thats what I mean by illegal inhabitants
