Regarding expiry of lease period

Lease period expired on 31/12/2009. I have received the advocate notice on 10/1/2010 for an ejectment suit under section 106 transfer of property act. As per the judgement of Suprement Court in Mangilal Vs Sugam Chand, AIR 1965 SC 101, the notice would be short by 1 day. Therefore the advocate notice is valid or invalid?

Being a student, first please indicate as to

(i) what is your understanding of the decision of the Suprement Court in Mangilal Vs Sugam Chand, AIR 1965 SC 101 -

(ii) what are your fact situations (the situation given by you is very sketchy - you did not say when you have been asked to vacate the premises) and

(iii) according to you which part of the SC decision would apply to your case. 

After hearing from you, I will give my view.
