Regarding gpa rights relinquishment

Respected sir, Here is my query.

Regd. GPA executed by 6 members infavour of 4 Members Jointly.  In that GPA, they had written that power is given to lease out of the properties (6 properties, 6 members, each 1 of the property for each member) only and not to sale the property. By using this power, agents already lease out the 3 properties. Another 3 properties left.

In that GPA, one of the agent wish to relinquish the power given by the principals. Is it possible to relinquish one of the agent in GPA by writing supplementary deed for this GPA.

Thank you,

Ramgopal

The agent/attorney may not use/ refuse the power granted by the principal.

Yes it is possible. Your principal and you should enter into supplementary relinquishment deed of your powers and it should be registered.

Yes the supplementary deed is possible. It is legally valid, moreover since the GPA Deed is only for the purpose of leasing out the property, the same need not be a registered deed since conveyance of property is not authorised to power agents.
