my father is no more.i,my mother &2 brother are living in flat which was jointly purchased by father and mother .my father had not filled nomination and will.can we brother make a release deed in faour of our mother.in that proces what stamp dutty & registration charges will attract in thane maharastshtra.
is that release deed will help me to transfer the flat to my mother.

was the property owned jointly by your parents or it was in the sole name of your father???
if it was jointly owned then, you need not bother. you all brothers can give relinquishment deed on Rs. 100 stamp paper in favour of your mother and your mother would become the sole owner of the flat.
but you need to ensure that the nomination form is filled up with the society so that incase your mother expire then you and your brother can ask the society to transfer the flat in the name of the nominee. otherwise you would be required to approach the court for obtaining legal heirship certificate.
