When he has surrendered and he is put under police remand and tourtued, the near relative can immediately complaint before the Judicial Magistrate  about the torture, praying for production of the accused before the court. On his production before the court the accused will himself submit in details about the torture.

People in indian are not aware of the main purpose of producton of the accused before the magistrate. Before  signing on the order sheet on production before the magistrate the accused has a right to refuse to sign untill and unless his grievances are recorded by the Magistrate.Once his grievance is recorded it is the duty of the Magistrate to issue show-cause/notice for reply on the grievances put forward by the accused.
