Removing lawyer from case

Sir,

In our civil case the lawyer appointed by us is not regular to the court though we pay him as per his demands. We are missing on our case due to this unfortunate circumstance. We want to remove him from our case and appoint a new lawyer. But he is not willing to withdraw his vakalat.

What is the procedure to remove the current lawyer and appoint a new lawyer or fight the case as "party-in-person"

If you are not satisfied with the services of your lawyer, you may take NO OBJECTION from him in a vakalat form and engage another lawyer or you may inform the court that hence forth you will contest the case as party in person and proceed accordingly.

In a recent A.P.High Court case it was held that the lawyer cannot withohod the files of the client on the premise of payment of his fees.  It was held that he should give back the files and take suitable action for the fees due to him.  Hence ask him to give back the files, or inform the court the position and appoint a new lawyer
