Rent control act - tamilnadu

hello,

in the state of tamilnadu, who pays the property tax ...i have  rented out a 2bhk flat and want to know who is responsible for paying the property tax....i read the below somewhere in wiki - for rent controller act in tamilnadu

Provisions

    Annual rent can be 10 per cent of total cost of the house at the time construction.
    Maintenance charges can be 10 per cent of the rent.
    Tenant also needs to pay the owner for property tax.
    Additional 15% rent for a furnished house.

You have been misinformed.  The property tax has to be paid by the owner of the house property and not the tenant.  If it is a flat, the tenant may have to bear the maintenance charges and other recurring expenses what has been incurred but not the property tax.  About rent and other aspects of additional rent towards the furniture and fittings can be recited and concluded in the rental agreement itself.

As rightly said by the learned Advocate Mr. T. Kalaiselvan, it is the duty of owner to pay tax on the property. In other words, the owner alone will have to face the consequences of non payment of said property tax.

 

The mode of calculation cited in the query to determine the rent, maintenance charge and tax are also having no legal force and not acceptable.
