Rent issue : paghdi flat in dombivali

Hi All,

We reside in pagdhi flat in KDMC area, there is a property dispute between owners and hence they are not accepting rent from laste 6 months. What should be the course of action from us? I heard we can go to court and pay the rent there. But i have a second question which is if we dont go to court, (A) can he ask us to evacuate the flat as its been 6 months no rental has been paid. (B) what if whenever such situation arises we pay the wholesome and get out of the issue and do  not do anything now.

If he goes to the court and asks for flat does court simply ask tenants to pass on the flat or first they ask if we are willing to pay the rent. As in such case we can pay and get out of it.

It depende up on the terms of condition of the agreement done between the party.

If u r the tenant then u MUST PAY THE RENT.

If agreement is not done and you are old tenant (for sake of brevity protected tenant)

Then Section 15 of Maharashtra rent control act applies to you.

On that ground you did not pay rent and tax he can file eviction suit but Court gives 3 or 4 months to deposit rent (Exact no. of months don't remeber) 

Better look at situation and if you feel your land lord can take aggressive step in court better deposit rent in court. And tell I did my duty of paying rent and tax honestly . in that M.A. make all people you feel are concern landlord. and state simply they have dispute myself only doing duty of paying rent 

Exact provision required to study because such rent are so neglibile paying adv. is more and no one study them or even read them
