According to the dictionary meaning, 'Res Judicata' meansĀ a case or suit involving a particular issue between two or more parties already decided by a court. Thereafter, if either of the parties approaches the same court for the adjudication of the same issue, the suit will be struck by the law of 'res judicata'.

Hello,

Criminal case cannot be filed or accused cannot be punished for the same offence more than once.

P. Venu (Advocate)     28 June 2022

What are the facts? What is the context?

G.L.N. Prasad (Retired employee.)     28 June 2022

If new facts come to light, there is still a possibility of re-opening the case and the rule is that one should not be punished twice for the same crime.  It all depends on facts presentation and convincing the court.
