you have to prove three facts. 1.  You are earning only Rs.13000/-.  2.  You are regularly paying interim maintenance of Rs.5500/- per month u/s 125 cr.p.c.  3. you are living in parental house, where you have no property rights as on date.   If you prove these facts to the satisfaction of the court, it is difficult for the court to give residential order to her.  Out of your earning of Rs.13,000/- the court already distributed the amount half-half to the parties.  Then it cannot force you to part with rental changes out of the Rs.6500/- allocated to you, in which you have to incur expenses to travelling to office and also pay some amount to your elder parents for staying with them.  You put your facts lucidly and wait for positive result.

Upon the facts of the case ,a divorced woman can claim residential rights.
