Residential land buying dispute

Dear Respected lawyers,

 

My father bought a plot in 1996 from a person whose husbend (say person's husbend is  Y) was died by that time. that propery was given by govrnament to her husbend  in 1984.

we started constructed the house in 2011 as it is well developed area. when we started the house, a lady came to us and claiming that property is owned by her father and bought from a person Y in 1984.

As she is a govt. lawyer and she has lots of good name in that area,  lady lawyer and local CI shouting at my father and making scare to give up that plot as lady lawyer's father is first owner of the plot.


Now the person  who sold that property to my father is no more. we have the witnesses while my father purchased that plot. We do not have linked document (The govt given land cerified copy to the first owner)

 

Please let me know, is that plot really belongs to lady lawyer as it was given by govrnament in 1984 ?

Is there any possibility to get the plot if we go to court in future... ?

You have to get it declared that your father is the absolute owner of the property by filing a suit for declration in the court.

1. How did your father acquire the property ? Registered Sale Deed ? Were there any other legal heirs to that man in whose name the property initially was held (apart from his wife). 

2. Whether this govt. advocate is also claiming through a registered sale deed ?

Please find below answers.

My father acquired the property from 1st owner's wife  by registration (sale deed).

There is no leagl heirs for the person who sold to my father.

 

2. Whether this govt. advocate is also claiming through a registered sale deed ?

Yes

All land transactions are to be done through a registered deed only and if your father purchased the property by such a registered deed and his name will be in the property records. Others may claime whatever but you will win if you have th eproepr documents proving that you have come to own the property.

What are the rules regarding the punar vaas land alloted by the govt for residential purpose in lieu of the land acquired by the govt. 

What in case the govt has already paid the amount for the land acquired and also given land as didnt have any house to live in at that moment.

Can a member who was living in the house constructed on the punarvaas plot sell the plot if he has moved to a new house 15 years ago.

This was all done during late 70s.
