Resign/ Notice Period

Dear sir,

I am employed in construction company from last One year and six month as Asst. Engineer.

Now i resgined from my job, in our company we have three month notice period, i gave notice period only one month, i have to pay for two month to company, but they are asking me to pay CTC of two month, as it is not mention in our HR policy.

There any rule by govt. of India pertaining to this.

WHEN U ACCEPT ANY JOB, IT WILL BE VERY CLEARY STATES ABOUT EXIT POLICY,RESIGN/TERMINATION ETC., EVEN U R SUPPOSE TO GIVE ACCEPTENCE. GOVERNMENT NO WAY FIX THE TERMS. IF SUCH THINGS ARE NOT MENTIONED IN UR OFFER/APPOINTMNT U CAN STICK ON TO 30 DAYS NOTICE.

It is a matter of contract.If your appointment letter does not specify three months notice forget it,.

Matters of rivate contrat are not enforceable by courts so it is the tem of the appointment which prevail over such matters. If term of CTC is there, you have to pay otherwise you are not liable for that.

Dear Mr. Ram Kumar,

What if in my appointment letter only 1 month notice period is mentioned but later after 4-5 years now the management is changing it to 3 month's notice period. In that case am I liable to serve 3 months notice? And if I dont is there any legal action that my company may take against me? I am ready to leave notice pay. i,e., salary for the period I am not serving. Will I get relieve letter?
