Yes, Vijay Raj Mahajan, is right. But this provisions make me uncomfortable and very disturbing. Is this so called “Restitution of Conjugal rights” a reasonable law? A law borrowed from English law, which the English themselves had already done away by the act of 1970. A home is built by heart, love, companionship, and understanding and not necessarily by rituals and certificates, and if it dies in the heart, the marriage remains an empty shell and no power on earth can save it. It is worthwhile to remember the memorable words of Achariya Kirpalini, while moving the restitution of conjugal rights in Parliament in the Bill for SMA 1954. He stated “Physically undesirable, morally unwanted and aesthetically disturbing”. Better to have a fresh look on this provisions, a provisions in exercise in futility.
