Restoration of Computed Pension

At the time of my retirement in 2001, I opted for computing 1/3rd amount of pension amouting to Rs.512696.76 .  In response to my query, the HR Department replied before retirement that "As per present guidelines, computed portion of pensionm irrespect of Rule 12(iii) or 12(iv) is restored 15 years after the date of retirement."

I have been hearing from certain people that the computed pension is not being restored by the company.  Can the company do this ? What is the legal position ?

Restoration of the commuted portion of the pension amoount is done as per the pension rules . years period is as per the Government pension rules, and you can veruify the same with the pension sanctioning authority.

restoration of pension after 15 years is done by government for its employees and by some PSUs as well, where they have such schemes. iN your case if your rules permit commutation, naturally they should provide for restoration after a certain period. therefore verify your organisation rules and apply for it, in case you are eligible.

It is foreign bank.  The Provident Fund Rules are silent on the restoration part.

Dear Mr. Ashok,

You can write to the bank and ask them when will the commuted portion will be restored.  They will surely inform you.
