A has widrawn an appeal due to an out of the court settlement with B in the form of specific performance agreement. if the B breaches the specific performance agreement, can A resume the appeal by amending the pleading.

Appeal cannot be re-opened as the matter is settled out of court. But fresh suit will lie on the fresh cause of action.
