Sir one my friend who is jm is facing this problem-
Fir was registered against A BCD. Police submitted charge sheet against A only and submitted final report against BCD. During evidence it seems BCD had active role in crime and state filed application under 319. Before the order A dies and death report was submitted in the file. Now what order he should pass? If whole trial is abated the offender BCD who should also be tried are exonerated. If he pass order under 319., death report of the main accused is on file. Please suggest with citation if any.
