Right to enjoy ancestral property

Can a minor son ask for right to enjoy ancestral property? All rental income from the property and all the property is controlled by his father's brother.

 

The minor child is 3rd generation legal heir to this property so his rights start from the day he was in his mother's womb. The uncle of this child doesnt give anything out of the property income nor is letting the child to live in the family ancestral home. The father of this child doesnt want to take legal action or anything against his brother nor is he taking any responsibility of this minor child who is depending on his mother for everything.

 

So can the mother of the minor child ask for right to enjoy the ancestral property without asking for partition? Any other advice about this case.
