Right to file an application

Can our right to file an interim application be open, even if we have not filed a written statement.? The written statement could not be filed in time, and the court is not allowing us to file an interim application to strike off the name of one of the respondents. (Matter in National Consumer Forum).

Any case law you have would be helpful, in addition to your answer.
