Role of Media in Judicial Activism-Constructive or Destructi

Dear Friends,

There are many instances wherein judiciary took note of an issue only when it had been flayed up by media? Do reflections or exposure in media and entertainment industry on laws and judicial system create awareness in society or promote judicial activism? Please comment.

Dr. Neera Bharihoke,

Media and judiciary  represent the prevalent norm of the society and they ought to work for the maximum welfare of the maximum citizens by dissimation of information in its most objective manner.  But it is important to point out that there are inherent faults whether it is of system, lack of norms, unprofessionalism etc.   Every body wants world to come after them and no body is willing or aggreable to be part of something right.  Cohesiveness amongst the Media and Judiciary is another issue. One upmanship is from what judiciary should abstain and Media should regulate its urge to jump the gun by indulging in the act of sensationalism.  Both of them represent the prevalent society and as the society progresses so does the changes in these limbs of Democracy. 

For record sake judicial activism started with the widening of Writ Jurisdiction of the Courts when within the parameters of Directive principles of state the Courts with a view to enlarge the scope of public welfare and issues concerning public at large took upon itself the responsibility of cleansing the system be it Pollution matter or Demolition spree by MCD in Delhi.  By the way thanks for initiating this discussion.

 Media is wonderful. During 26/11, one of the channels was talking to terrorists and broadcasting it live. Also, perpetrators in Pakistan were getting live coverage of how the destruction was taking place and pin pointing the targets step by step.

 What better target practice could Pakistani handlers have got than what was provided by our electronic media? The media vied with each other in repeatedly showing the destruction, the manner of destruction and the collateral damage. CNN started it all in Gulf War. our media went a step further by talking to the terrorists. What a freedom of press?

 Media is destructive.

Look what it has done to  cases involving Jessica Lall, Priyadarshini Mattoo, Nitish Katara and now Ruchika. The poor guys are behind the bars are waiting to go behind the bars.
