RTI--A Ploy to get Adjournments

I here read at LCI that RTI can become a ploy to get adjournments--How ,let us see---



On a certain court date---any one of litigants can show that he has applied some RTI and is awaiting reply of the same.



On Next date the same Litigant can say---that he has applied for the first appeal and waiting for the reply.



On the next date he can say--that he has applied for the second appeal and waiting for the reply.



On the next date he can say that he has filed a case against RTI officials for this or that reason,he is waiting for this or that ---this way he can go on prolonging the Lawsuit.



Is this feasible ?


yes....... No......



If yes,what is the remedy ???

Applying under RTI or appeal made under RTI is no ground of adjournment of court proceeding

These are not the good grounds.  What your advocate is doing he can press for call for the documents from the department.  So easy.

In one case they babus gave false information so that the man wastes his time in appeals. He went to high court but got no relief there. So he moved a SLP in the Supreme Court where he won't get any relief. Let it be known that SLP is an appeal where terrible injustice has to be done. Our Constitution is the longest in the world but only less than 1% of it is useful or used. His matter was put up before the registrar. The concept and process of due process of law is absent in the Constitution which is just the opposote of "Procedure established in accordance with law" which cannot be subjected to judicial review. World renowned jurist Professor Hart of Cambridge university examined Indian Constitution in depth and found some semblance of "due process law in article 21 of the Constitution but was disppointed over the fact that India being a signatory of International treaties like the ICCPR,UNDHR etc has not made these treaties binding and that they only exist on paper . Let me make it clear RTI is not FOIA[USA'S FREEDOM OF INFORMATION ACT). There furnishing false information means over 100 years of JAIL. Indian Judges don't have law making powers. But now they are doing it slowly.
