RTI ACT, 2005

A PERSON HAD APPLIED FOR INFORMATION FROM A STATE GOVT INSTITUTION. THE SAID INFORMATION WAS REQUIRED ON 8 COUNTS. BUT THE PIO SUBMITTED INFORMATION ONLY ON 4 COUNTS, AND PARTIALLY SUBMITTED THE REPLY IN RESPECT OF OTHER 4 COUNTS (LEAVING THE REST OF 4 COUNTS INCOMLETE WITH REGARD TO THE FURNISHING OF INFORMATION), AS SO DEMANDED IN THE APPLICATION BY THE INFORMATION SEEKER.

CONSEQUENTLY AN APPEAL WAS PREFERRED TO THE 1ST APPEALTE AUTHORITY, AND ON HEARING NOTHING FROM HIS SIDE, APPEAL WAS MADE TO THE STATE INFORMATION COMMISSION. IN THE APPEALTE PROCEEDINGS BEFORE THE COMMISSION  FOLLOWING FACTS IN ISSUE WERE  BROUGHT TO THE NOTICE OF THE COURT  FROM THE SIDE OF COMPLAINANT (I.E. INFORMATION SEEKER)

1)THAT THE INFORMATION FELL ON 4 COUNTS (AND HENCE WAS INCOMPLETE WITH REGARD WITH THOSE 4 PARAMETERS) .

2)THE ENTIRE INFORMATION SO SENT BY THE PIO, WAS NOT ATTESTED UNDER HIS OFFICIAL SEAL

4)THE SAID INFORMATION WAS NOT FURNISHED WITHIN A TIME PERIOD OF 30 DAYS AS REQUIRED BY THE ACT.

THE STATE INFORMATION COMMISSIONER REJECTED THE CONTENTION OF THE INFO.SEEKER WITH REGARD TO POINT 1 AND POINT 4. WITH REGARD TO POINT 3 AND 4,HE PRONOUNCED THAT INFORMATION PROVIDED MUST HAVE COMPLIED WITH THE PROVISIONS RELATING TO SIGNATURES, ATTESTATION, AS WELL AS THE DESIGNATION OF THE OFFICERS PREARING AND COMPILING WITH INFORMATION TO BE SENT. IT HAS BEEN 20 DAYS SINCE THE ORDER WAS RELEASED FROM THE OFFICE OF THE STATE INFORMATION COMMISSIONER, BUT THE PIO STILL HAS NOT COMPLIED WITH THE STANDING INSTRUCTIONS OF THE ORDER OF THE HON'BLE STATE INFO. COMMISSIONER.

WHAT RECOURSE IS THEIR AGAINST SUCH ACTION OF PIO. HOW CAN THE INFORMATION SEEKER PROCEED FURTHER IN THE MATTER ?
