Rti - is this wrong ??

wife is maharashtra state govt. employee

in case of 1 RTI app filed by me, 

wife, as 3rd party, submitted written request to PIO stating ''do not to give information to my husband as court litigation is going on between us.''

before this PIO DID NOT give written notice to her seeking her opinion.


IS THIS BREACH OF PROVISION ??

If the information is treated as ‘confidential’ by a third party, then the following steps will have to be 

taken by the PIOs: 

ÿ The PIO has to give a written notice to the third party within five days of the receipt of an 

application for information seeking his opinion, whether the information should be

disclosed to the applicant or not. 

ÿ The third party has to make a submission to the PIO within 10 days, whether to disclose 

the information or not.

ÿ Within 40 days of the receipt of the application, the PIO has to make a decision. Should 

the information related to the third party be provided to the applicant or not, and then 

convey his decision to the third party. 

ÿ The third party can appeal against the decision of the PIO to disclose information relating 

to him/her to an RTI applicant to appellate authorities.
