RTI - State Information Commission valid?

Why should the State Information commission under (RTI) be manned by person wo does not kow the fundemantal pronciples of Law? it should be manned by Judicial officer and advocates of standing not less than 10 years in the bar.The present RTI is like an appeal from Ceaser to Ceaser's wife. we need a change in this diretion.

Act itself is without any nail or tool. It requires various changes therein.

The answer can be found in the appointment of judges. Are pliable persons appointed to these posts? If the answer is yes, the question of appointment of retired bureaucrats to CIC/SIC is meaningless.

Read the comments of Justice Bilal Kazi, who retired as Chief Justice on 18th November. It is classic.

Incompetence from magistracy right upto SC.

Consumer Reddressal  Forum is Presided by Legal People, but DISTRICT FORUM/STATE FORUM outcome is negligible. So let us wait & watch  for the outcome of  STATE INFORMATION COMMISSION.

I think out of three persons manning the District Forum, one is a legal man (perhaps a retired district judge). But, I am not sure.

Composition of the District Forum. — (1) Each District Forum shall consist of,—

(a)  a person who is, or  has been, or is qualified to be a District Judge, who shall be its President;

(b) two other members, one of whom shall be a woman, who shall have the following qualifications, namely:—

(i)    be not less than thirty-five years of age,

(ii)   possess a bachelor's degree from a recognised university,

the main problem withour country is that many of these posts are filled in return of "favours received"

however,if we have patience and time,we could expose those imcopetent people.

whatever drawback it (RTI act in India) may have,it is a weapon available to us.  Let us try use it maximum with whatever drawback in  its implementation.

Anil Agrawal (Retired)     20 December 2009

We all live with all the drawbacks. What else can we do?

The draw back is, the buraucratic manouvres readily compromise with the officials who deliberately evade or cheat the applicants by hook or by crook. If at all headed by the Judicial officers, a sense of fear will rein that their real faces will be brought to light. To overcome this methodology, the Information commission should necessarily be presided over by a sitting judicial officer, though the other members from retired buraucratic persons.

Anil Agrawal (Retired)     22 December 2009

No way. Government can't put a noose around its neck by appointing a judicial officer.

Anil Agrawal (Retired)     22 December 2009

Government has burnt its boat by passing the RTI Act.

Please don't rub salt on its wounds now. It is thinking of repealing it, if not, diluting it.
