Rules for stay order on construction

Hello Lawyers,


I am basically from IT field. I had issue at home. I started to renovate my home. I extend my floor. My home is situated in co operative society. My home have 3 side open space and a common wall(which is share between us and my neighbour).

Now I have all legal documents to recostruct my home
 for e.g. 1) society NOC.
 2) Legal approved map from the corporation.
 3) Approved certificate by our Corporation etc.

Now, my issue is, my neighbour threat me that "I will put the stay order on your construction"
 Now the reason for he want to stay order is, because havy rain on saterday(22nd Sept 2012) at Vadodara, our slab is full of water and because of moisture some water is fallen from my neighbour's ceiling. So he was agnry and give us threat for stay orders.

Now I want to know that, even if I have society NOC and all legal document Can he stop our construction? For stay order only my neighbour statement is necessary or all othre member of my society is aslo necessary?

Hello Sir,


Thank you very much for the quick response. Sir, I already apologise for whatever happned on that day. But after apology from my side he was used some language that heart me and my family. It was a festival day(Ganesh Chaturrthi) so I was not able to flushed all the water from my terrace, if I do, then all the water drop on Ganpati Stage. So for a that reason I refuse to drop all water from my terrace.
