Salary change issue after getting my offer letter.

Hey Frined,
I need legal advice.
I have my offer letter with an MNC with a higher salary package and my date of joining is coming 13th March, 2012.
Well, now HR person are saying that by mistake they have offered me a higher salary-package and hence my salary needs to be revised to a lower salary level.
Now since my expectations are raised after getting this offer letter, I don't want to accept a lower salary package.
In this scenario, how should I negotiate with the HR in order to ensure that my offered salary is not compromised ?
Also, if the HR person is rigid to offer me another offer letter with reduced salary, what are the legal options available with me to get the redressal ?

Each word in letter of offer is to be honored by both the parties.

You may run a thorough check on this employer, company, promoters, line management, HR, market image, brand equity, ranking, etc

It seems for sure all the tantrums of this HR personnel are verbal, and in all probabilities this HR personnel shall refrain from supplying any communication in writing.

Or they are trying to close the door on you in a tactical manner. You must be abler to read between the lines.

Or they have a better choice.

The offer letter is not just any document it has to be prepared by one, checked by second, recorded by third and approved by someone and then is finally to be signed by competent employee.

This could be another bad tactics to somehow lure candidates and then leave no other option but to accept the revised offer made in verbal and then take back first offer letter and issue another one.

This could be due to a not so good reference check...!!!!!!!

If you join there may be some other surprise e.g. service agreement, bond, extended work hours.

Take a wise decision to suit you on the long run.

Hi Sir,

Thanks for your valuable suggestion.

Today the HR people called me several times & as per their suggestion, I visited their office .

My meeting with the senior HR Managers were arranged and they all told me that the related HR did not scruitnised my last salary slip very well and hence the offer, she gave to me, was more than 30%,. The related HR manager also insisted several times that as per standard guideline of this company, any new employee can't get salary hike of more than 30% in comparision to his last CTC.

Also, the HR manager told me that my joining has been put on hold due to these disconnects. That's why, as per him, I have not got any confirmation call from HR during last 6 days.

Also, the HR manager is saying that I don't have any option other than accepting the new offer with much lower salary package, otherwise the related HR has the authority to withheld my offer and stop my joining and in this case I will be helpless (as per him). I simply want to know whether his this statement can be true anyway?  Can the HR person wiltheld any offer-letter arbitrarily ?

My date of joining is 13th March, i.e. tomorrow. So, please respond ASAP.

Thanks & Regards :

Ravi

If you have not left the current job then you can refuse the new offer and remain with current employer and retain the offer letter and use it for future ventures by explaining any reasons for not joining as deemed fit.

If you have already left the previous employment and  disconnect as pointed out by HR personnel, are affecting you, you can protest or agitate, however it shall be lengthy process and you shall have to hunt for another job.

If you can negotiate and arrive at 30% increase on your last CTC and if the same is acceptable to you, you may take a final decision. In this case if you wish you can submit a polite and gentle email/letter to HR personnel expressing yourself.
