Salary Issue

Hello,

I am a student and i work along with my studies. I was hired by an "IT" company on 20th of apr. I joined this company on 22nd of april though i was not comfortable with the enviroment over there. after few days my boss discussed with me about my work and said if you are not comfortable working in here you can discontinue. On 2nd of may my boss and i had a discussion about my work again and he asked me to quit if i am not comfortable. so i stood up on my work station and i said sir i am really not comfortable working in here so i want to leave he said okay you can leave now and i left the office.

i worked for 11 days and according to my salary annexure i should get at least 6000 rs. when i called my boss and asked for salary he said... accordingly you left the company.. i dint ask you to leave so there would be no salary but i need my salary. i requested him but he said no to me and he wont give my salary like this so i want to take an action against him.

is it true that i left the company that is why i wont get my salary?

what does law say about this?

and if i should get my salary how to claim for it? what legal actions can i take against him? where in jaipur i can go where i can take an legal action against him?

please help me i am in need.

You are surely entitled for proportionate salary for the days you have worked. Have you signed any attendance register! Have you surrendered your employee ID Card or have this. Send a simple letter by Registered Post (Speed Post with Proof of Delivery preferred) to the HR Manager, demanding that your salary for the days worked be settleed and wait for 30 days. In case you dont get a response, lodge a complaint with the Labour Inspector for your unpaid wages.

Yes sir they have my attendence... for that they use some software. i do have offer letter but there were no id cards. i went to the office to discuss the same with my boss but it seems he will not give me my salary at any cost. so i want to take legal action straight away. please tell me the procedure to file a case? or where in jaipur i can lodge a complaint with the labour inspector? but i will also send a letter to them as you said.

Filing a case is a long-drawn process and it may not be necessary in your case. Even for filing a case, one has to issue a notice, setting out his claim and hence write a letter first to the management, followed by complaint to the labour inspector.
