Salary not being paid by employer

Hello,

I was working in a reputed IT company in Bangalore and I resigned from there on March 9th, 2012. I joined this company 11th July, 2011. There was a variable pay component in my salary which was Rs32000/- which is clearly mentioned in my offer letter.

Each and every employee who has joined after July, 2011 got there variable component till December, 2011 with the Salary of Feb, 2012.

But I did not get that, when I asked the concerned HR he said you will get the variable pay (from July 2011 to December 2011) in your full and final settlement but you will not get the variable pay component for Jan 2012 to March 2012 because you were in notice period.

I have two questions here:
1. When the company given my full and final settlement then there is only variable paid = Rs3099/-. Which is wrong. Where should I complain regarding this.
2. If they have not mentioned anything regarding notice period in their offer letter then howcome they are saying that the last quarter variable pay will not be paid to you because you were in notice period.

Please clarify this.

Reputed companies provide comprehensive details in the employee rule book and circulate it in the welcome kit to new joinee. You may refer to your appointment letter, certified standing orders, and employee rule book.

Don't go by verbal statements of HR personnel. You may study the rules applicable to variable pay, applicable to your designation.

Can you obtain copy disbursement sheet/salary slip of other employees?

You can submit your contentions in writing and request for illustrative reply in writing.
